NYC College Line Terms of Use

Welcome to NYC College Line!

NYC College Line, an initiative of Graduate NYC! (www.gradnyc.com), is an interactive, online resource for students, parents, and education professionals across NYC; it serves as a “one-stop shop” for existing college readiness, transition, access, and success resources. We aim to create a dynamic community for students, parents, and education professionals to share information and communicate with one another. The development team consists of individuals from the NYC Department of Education, City University of New York, the NYC Office of the Mayor, and Goddard Riverside Community Center (collectively with the directors, officers, employees, agents and representative of each of them, the “Graduate NYC! Team”). We hope your experience using NYC College Line will be enjoyable and productive.

Please read the following terms of use carefully before using this website.

By accessing or using NYCCollegeLine.org (“Site”), including but not limited to all subpages and any products, software, and services referenced on the Site, you agree, without limitation or qualification, to these Terms of Service (“Terms”). These Terms apply to all visitors, registered users, and others who access the Site (collectively, “Users”). If you do not agree with any of these Terms, you are not authorized to use the Site. The materials contained in the Site are protected by applicable copyright and trademark law. These Terms create a legal agreement between you and Graduate NYC! and the Graduate NYC! Team, and supersede any prior agreements between you and Graduate NYC! and the Graduate NYC! Team regarding the Site.

  1. Your use of this Site:
    1. You agree to access and use the Site for lawful purposes only. You are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules, and regulations pertaining to your use of the Site. A few examples of applicable laws include those addressing defamation, invasion of privacy, obscenity and child pornography, and online gambling. Without limitation, by accessing the Site, you agree that you will not:
      1. Use the Site to commit a criminal offense or to encourage others to engage in any conduct which would constitute a criminal offense;
      2. Use the Site in a way to give rise to civil liability or encourage others to engage in any conduct which would give rise to civil liability;
      3. Otherwise use the Site in a way that infringes or violates any rights of any party;
      4. Use the Site to impersonate other parties or entities, mask the identity of an account or computer, or engage in abuse of others, such as by sending harassing, obscene, threatening, abusive, deceptive, or anonymous messages;
      5. Use the Site to upload any content that contains a software virus, "Trojan Horse," or any other computer code, file, or program that may alter, damage, or interrupt the functionality of the Site or the hardware or software of any other person who accesses the Site, or which could result in the theft of data from the Site;
      6. Upload, post, email, or otherwise transmit any materials that you do not have a right to transmit under any law or contractual relationship;
      7. Alter, damage, or delete any content posted on the Site (except that you may modify or delete content you have posted);
      8. Disrupt the Site or its servers or networks in any way; or
      9. Claim a relationship with or represent any business, association, or other organization with which you are not authorized to claim such a relationship or to represent.
    2. The Graduate NYC! Team has the right to require Users to limit or refrain from other specific uses or activities if such use or activity interferes with efficient and/or lawful operations of the Site.
  2. Your passwords and account security
    1. You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Site.
    2. Accordingly, you agree that you will be solely responsible to the Graduate NYC! Team for all activities that occur under your account.
    3. If you become aware of any unauthorized use of your password or of your account, you agree to notify Graduate NYC! immediately at nycollegeline@cuny.edu.
  3. Privacy of Personal Information You Provide
    1. In order to access certain aspects of the Site, you may be required to provide information about yourself (such as identification or contact details) as part of the registration process for the Site, or as part of your continued use of the Site. You agree that any information you provide when registering for or continuing to use the Site will always be accurate, correct, and up to date. To learn how Graduate NYC! may use such information, please visit the NYC College Line Privacy Policy, which is incorporated into these Terms by reference.
  4. Your Submissions
    1. The Site contains functionality such as the “Ask an Advisor” section, where Users can pose relevant questions to academic and college advisors, and the “Forums” section, where Users can post and respond to questions and concerns. These areas allow Users to upload content to the Site (collectively known as "Public Areas"). Public Areas also include message boards, User reviews, blogs, etc. You agree that you will not upload or transmit any communications, data, images, videos, information or other content of any type or medium (collectively, “Content”) to the Public Areas that infringe or violate the requirements of Section I of these Terms, or that are irrelevant to the scope and purpose of the Site.
    2. By submitting Content to the Public Areas, you agree that such submission is non-confidential for all purposes. You agree that you will not submit any Content that contains personally identifiable information (e.g., name, phone number, email address, or web site URL) of another person without their permission.
    3. You agree that you will not send or transmit to Graduate NYC! by email, including through the email addresses listed on the "Contact Us" page, any Content that infringes or violates the requirements of Section I of these Terms. If you submit Content that contains any business information, idea, concept, or invention to Graduate NYC! by email, you agree such submission is non-confidential and non-proprietary for all purposes.
    4. You are responsible for any Content you submit to the Site and any harm resulting from it.
    5. You warrant and represent that you either own or otherwise control all of the rights to Content you provide to the Site, including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Content, or that your use of the Content is a protected fair use. You warrant and represent also that the Content does not violate these Terms and that you will indemnify and hold harmless Graduate NYC! and the Graduate NYC! Team from any claims arising from Content you provide.
    6. By posting Content on the Site, or if you submit any Content to Graduate NYC! by email, you are granting Graduate NYC! a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use the Content on the Site until you remove or delete it, including but not limited to, the right to reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the Content.
    7. If you delete Content, Graduate NYC! will use reasonable efforts to remove it from the Site, but you acknowledge that caching or references to the Content may not be made immediately unavailable.
    8. Whenever possible, we will credit you as an author, and by posting Content on the Site you give Graduate NYC! the right to use your name for attribution purposes.
    9. Unless you specify otherwise, all Content you submit to the Site, including but not limited to Content containing business information, ideas, concepts, or inventions, is submitted under the terms and conditions of a Creative Commons Attribution NonCommercial Share Alike 3.0 license, or any successor or equivalent Creative Commons license. Under the terms of this license, you permit anyone to copy, distribute, transmit and adapt your Content, royalty-free, for non-commercial purposes on the condition that they credit your authorship each time they do so. You also permit others to distribute derivative works of your Content, but only if they do so under the same Attribution Non-Commercial ShareAlike license that governs your Content. Please read the full text of the Attribution NonCommercial ShareAlike 3.0 license (which includes a link to the full Creative Commons Legal Code). If you want to offer your Content under a different Creative Commons license indicate on your submission the license that applies.     10. If you wish to keep any Content private or proprietary, do not submit it to the Public Areas or to Graduate NYC! by email.
  5. Intellectual Property
    1. When we refer to “Intellectual Property Rights” in these Terms, we mean all patent rights; copyright rights; moral rights; rights of publicity; trademark, trade dress and service mark rights (and associated goodwill); trade secret rights; and all other intellectual property and proprietary rights as may now exist or hereafter come into existence, and all applications for any of these rights and registrations, renewals, and extensions of any of these rights, in each case under the laws of any state, country, territory, or other jurisdiction.
    2. Service marks and trademarks contained in or displayed on the Site, Content that Users upload or share, and the contents of linked sites operated by third parties, are the property of their respective owners. All other design, information, text, graphics, images, pages, interfaces, links, software, and other items and materials contained in or displayed on the Site, and the selection and arrangements thereof, are the property of Graduate NYC!. All rights are reserved.
    3. Graduate NYC! respects the intellectual property of others and it asks its users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement via its display on the Site, or other use by Graduate NYC!, you may submit a notice pursuant to the Digital Millennium Copyright Act ("DMCA") to The City University of New York (a Graduate NYC! Team member). Please review CUNY’s DMCA information for assistance in making a claim.
  6. Your Interactions with Other Users
    1. Please keep in mind that you are solely responsible for your interactions with other Users. This includes but is not limited to commenting on blog posts or uploaded Content, or communicating with other Users. We reserve the right, but have no obligation, to monitor disputes between you and other Users. Graduate NYC! and the Graduate NYC! Team will have no liability for your interactions with other Users, or for any User’s action or inaction. Please help to make the Site a positive and respectful community.
  7. Reporting Violations
    1. If you have reason to believe that any Content or activity on this Site violates these Terms or is illegal or inappropriate, or to report any other abusive behavior in connection with the Site, please contact us at nycollegeline@cuny.edu.
  8. Disclaimer re Third Party Information
    1. The Site contains Comments and other information generated by groups or individuals whose expressed views do not necessarily represent the views of Graduate NYC! or the Graduate NYC! Team, and links to sites owned or operated by parties other than Graduate NYC! and the Graduate NYC! Team. These pages and links are provided for your convenience only and Graduate NYC! and the Graduate NYC! Team accept no responsibility for their content. The inclusion of these pages and links does not imply Graduate NYC! or Graduate NYC! Team endorsement of the sites’ content, products or services or, unless expressly disclosed otherwise, any sponsorship or affiliation with the sites’ owner or operator.
  9. Children Under 13
    1. In accordance with the Children's Online Privacy Protection Act (COPPA) of 2000, Graduate NYC! does not accept registrations for this Site from, or knowingly collect information from, children under 13 years old. If you are under age 13 and wish to receive information from us, please do not attempt to register with this Site yourself, or provide any personal information about yourself to us. Graduate NYC! requires a parent or legal guardian to provide verifiable consent before distributing any of this Site’s information to children under age 13.
  10. Termination
    1. The Graduate NYC! Team may at any time terminate its legal agreement with you and your right to access and use this Site if you have breached any provision of the Terms, Graduate NYC! is required to do so by law, or Graduate NYC! no longer maintains the Site and terminating the service. You may also delete your account or disable your application at any time.
  11. Right to Remove Content and Discontinue Service.
    1. Graduate NYC! has the right (though not the obligation) in its sole discretion to refuse or remove any Content at any time that violates these Terms, Graduate NYC! policy, applicable federal or state statutes, or common laws.
    2. Graduate NYC! also reserves the right to modify, suspend, or discontinue the Site, with or without notice, at any time and without any liability to Users.
  12. Disclaimers
    1. The Content on this Site is the views and opinions of its authors and is their sole responsibility. The Site and its Content are distributed and transmitted "as is" and "as available." To the full extent permitted by applicable law, Graduate NYC! and the Graduate NYC! Team make no, and hereby disclaim all representations and warranties of any kind, either express or implied, including but not limited to warranties regarding the operation or administration of the Site, or the quality, accuracy, completeness, reliability or timeliness of the Content on or linked from the Site, warranties of title or implied warranties of merchantability or fitness for a particular purpose, freedom from interruption, freedom from computer virus, freedom from errors or omissions, non-infringement of Content on or linked from the Site (whether by Graduate NYC! or a third party), including any of the design, information, text, graphics, images, pages, interfaces, links, software, or other materials and items contained in or displayed on or linked from the Site.
    2. Graduate NYC! and the Graduate NYC! Team are not responsible for damages of any kind (regardless of whether they were foreseeable) that may arise from the use of, or the inability to use, the Site and/or the Content on the Site, whether the Content is provided by Graduate NYC! or a third party.
    3. You expressly agree that you use the Site solely at your own risk. Without limitation, you are solely responsible for any damage to your computer system or other device or loss of data that results from the download or other use of Content from the Site.
  13. Modification of These Terms
    1. Graduate NYC! reserves the right to revise and otherwise change these Terms at any time and without notice. Any modification is effective immediately upon posting, unless otherwise stated. Your continued use of the Site following the posting of any modification signifies your acceptance thereof. You should periodically visit this page to review the current Terms.
  14. Miscellaneous Terms
    1. You agree that if Graduate NYC! and/or the Graduate NYC! Team does not exercise or enforce any legal right or remedy which is contained in the Terms, such omission will not be taken to be a formal waiver of Graduate NYC!’s or the Graduate NYC! Team’s rights and shall not be construed to be a modification of the Terms.
    2. If any court of competent jurisdiction rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
    3. The Terms, and your relationship with Graduate NYC! under the Terms, shall be governed by and construed in accordance with the Laws of the State of New York (notwithstanding New York choice-of-law rules). You agree that any and all claims asserted by or against Graduate NYC! and/or any or all of the Graduate NYC! Team, arising under or related to the Terms shall solely be heard and determined either in the courts of the United States located in the City or County of New York or in the courts of the State of New York located in the City and County of New York.
    4. These Terms shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Site and its subpages; provided, however, that in the event of a conflict between such other terms and these Terms, these Terms shall control.
    5. The Site’s Content, including without limitation that provided by Graduate NYC! and its licensors and the Graduate NYC! Team, and responses to “Ask an Advisor” and forum postings, are for informational purposes only. The Content is not intended to be a substitute for professional academic or college preparation advice. Always seek the advice of your guidance counselor or other qualified academic or college advisor with any questions you may have regarding the college preparation and application process. Never disregard professional academic or college preparation advice or delay in seeking it because of something you have read on the Site!
